Terms of Service

Effective: 10 November 2025. These Terms govern your use of mzansifood.com, operated by MzansiForsho Pty Ltd (Reg. No 2024/595329/07). By using our platform, you agree to these Terms.

1) Using the Service

MzansiFood provides a marketplace connecting customers, independent restaurants, and delivery partners. Unless stated, restaurants are the sellers of items; delivery partners are independent contractors.

2) Accounts

  • Provide accurate info and keep your credentials secure.
  • One person per account. We may suspend for fraud, abuse, or policy breaches.

3) Orders, Pricing & Payment

  • Prices/fees/taxes shown at checkout; photos are illustrative.
  • Charges are authorised to your selected payment method; tips go to drivers (less payment costs where applicable).
  • Allergen information is provided by restaurants.

4) Delivery & Pickup

ETAs are estimates. You must be available to receive the order; redelivery/return fees may apply. Risk passes on delivery to your address or pickup counter.

5) Cancellations & Refunds

  • Before prep: cancel for a full refund.
  • After prep/driver assigned: partial or full charge may apply to cover costs.
  • Quality/missing items: report within 24 hours in Help; refunds to the original method.

6) Promotions & Credits

Promos/credits have stated expiry and conditions and may be withdrawn if misused.

7) Ratings & Reviews

Must be honest and non-abusive. We may moderate or remove violating content.

8) Prohibited & Restricted Items

No illegal items. Age-restricted items (e.g., alcohol) only where enabled by law with valid ID checks.

9) Liability

To the maximum extent permitted by SA law (incl. CPA), we exclude indirect or consequential loss. Our aggregate liability is limited to the greater of R1,000 or the amount paid for the order giving rise to the claim.

10) Termination

You may close your account anytime. We may suspend or terminate for fraud, abuse, or breach.

11) Governing Law & Disputes

South African law (incl. ECTA). Courts of [Province]. Nothing limits statutory consumer rights.

Annex A — Vendor (Restaurant) Terms

  • Fees: Commission [X]% + payment fee [Y]% + R[0.ZZ].
  • Payouts: Weekly to verified bank (less refunds/chargebacks).
  • SLAs: Accept/decline in 5 min; accurate prep times; stock updates.
  • Compliance: Allergens, pricing accuracy, VAT, hygiene licensing.

Annex B — Driver (Independent Contractor) Terms

  • Status: Independent contractor; no employment relationship.
  • Earnings: Base + distance/time + tips; weekly payouts.
  • Requirements: SA ID/permit, licence, roadworthy vehicle/bike, thermal bag.
  • Conduct: Road laws, food safety, courteous service, no tampering.
